Welcome to Cabo Dive. By booking or participating in any of our services or activities, you agree to the following terms, conditions, and disclaimers.
Please read this information carefully
📄 Section 1: General Terms of Participation
By engaging in any Cabo Dive experience, including scuba diving, snorkeling, training, tours, or charters (collectively referred to as “Activities”), all participants (“Participants”) and their guardians (if applicable) acknowledge and agree to:
Assume all risks associated with ocean-based activities, including but not limited to:
Drowning, injury, decompression sickness, marine life encounters, equipment failure, and adverse weather
Be in good health and physically capable of participating
Follow all safety guidelines and instructions provided by Cabo Dive staff
Not participate under the influence of alcohol or drugs
Ensure that any minor Participants are supervised and meet age/fitness requirements
Cabo Dive reserves the right to refuse participation to anyone who does not meet safety standards or poses a risk to themselves or others.

Local Diving
100% payment required to confirm booking, 24 hour cancellation policy
❌ Section 3: Cancellation & Weather Policy
Weather-Related Cancellations
Cabo Dive may cancel or reschedule any activity due to:
High winds, heavy rain, lightning, unsafe sea conditions
Closure of the Cabo San Lucas Marine Port
If canceled due to weather, you will receive a full refund within 24 hours
Local Diving:Guest Cancellations
100% refund if canceled 24 hours or more in advance
No refund if canceled less than 24 hours in advance
Rescheduling Option
If your dive is rescheduled, you may:
Attend the new scheduled date, or
Request a full refund within 24 hours of reschedule notice
🐋 Section 4: Wildlife & Whale Watching Policy
While our experienced team gives you the best chance to observe marine life, sightings are not guaranteed due to factors like:
Animal behavior, migration patterns, and time of year
Weather and underwater visibility
Habitat preferences and population sizes
During whale season, there’s a 99% chance of seeing whales, with:
90% being humpbacks
9% including gray, pilot, minke, Bryde’s whales, orcas, and others
If no whales are seen, you are invited to join another tour within 48 hours — free of charge, subject to availability.
⚖️ Section 5: Liability Waiver & Legal Jurisdiction
By participating in Activities, you agree to:
Waive all claims against Cabo Dive, Nautilus Tech Dive (Actividades de Nautilus SA. de CV), their staff, owners, affiliates, and contractors
Assume full responsibility for your safety and well-being during all Activities
Indemnify and hold harmless the business and its representatives in the case of injury, loss, or death
Authorize emergency medical care if necessary, and agree to cover any related costs
Governing Law
These terms are governed by the laws of Los Cabos, Baja California Sur, Mexico
Any legal disputes will be resolved exclusively in local courts
⚠️ Section 6: Participant Responsibilities
By booking or participating, you confirm that:
You are medically fit for scuba diving or related ocean activities
You understand the risks involved and accept them voluntarily
You will follow all rules and instructions
You will not hold Cabo Dive responsible for circumstances beyond their control
Failure to comply with any of these terms may result in immediate dismissal from the Activity without refund.
